Terms of Use

For the purposes of these Terms:

“Platform” means PersonalTraits and all websites, applications, pages, dashboards, tools, tests, reports, interfaces, and digital services operated under the PersonalTraits brand.

“Services” means the Platform and all related services, including the TSI Test, account features, free results, Premium Reports, AI-assisted analysis, relationship comparison features, digital content, sharing tools, and support services.

“TSI” or “Tension Score Index” means the proprietary personality and motivation model used by PersonalTraits to interpret internal dynamics through tension-based analysis.

“TSI Test” means the questionnaire, scoring system, interpretive model, and related tools used to generate a user’s PersonalTraits profile.

“Results” means the scores, interpretations, summaries, analyses, charts, recommendations, or other outputs generated from your answers, whether free, premium, AI-assisted, or automatically generated.

“Premium Report” means any paid, extended, downloadable, personalized, or enhanced analysis offered by PersonalTraits.

“Relationship Comparison” or “Profile Comparison” means any feature that allows two or more users to compare their TSI profiles in order to generate a compatibility score, shared relationship report, affinity analysis, friction analysis, or relationship suggestions.

“User Content” means any content submitted, uploaded, shared, transmitted, or provided by you through the Services, including comments, testimonials, feedback, text responses, profile sharing, public posts, or social sharing content.

“AI Features” means any feature that uses artificial intelligence, machine learning, large language models, generative AI, or similar technologies to generate, personalize, enrich, translate, summarize, or analyze content.

“Third-Party Services” means services, software, APIs, platforms, payment processors, hosting providers, analytics tools, AI providers, social networks, or other services operated by third parties and used in connection with PersonalTraits.

PersonalTraits provides a proprietary personality and self-discovery experience based on the Tension Score Index (TSI).

The TSI model is designed to help users better understand their internal dynamics, motivations, preferences, tensions, and possible patterns of decision-making. The model is structured around eight major tension dimensions:

1. Energy;
2. Security;
3. Belonging;
4. Status;
5. Identity;
6. Coherence;
7. Freedom;
8. Mortality / Finitude.

PersonalTraits may provide free test results, paid premium reports, personalized analysis, AI-assisted interpretation, relationship comparison tools, social sharing tools, and other self-discovery experiences.

The Services are provided for personal reflection, education, self-discovery, personal development, and entertainment purposes. PersonalTraits does not claim to fully define, measure, diagnose, or predict any person.

No personality test can fully summarize a human being.

By accessing or using the Services, you confirm that:

1. you have read and understood these Terms;
2. you agree to be legally bound by these Terms;
3. you agree to our Privacy Policy;
4. you will use the Services only in accordance with applicable laws and these Terms.

You accept these Terms when you visit the Platform, create an account, take the TSI Test, submit answers, view free Results, purchase or access a Premium Report, use an AI Feature, use a relationship comparison feature, share or download Results, or submit feedback, testimonials, comments, or other User Content.

If you use the Services on behalf of an organization, you represent that you have authority to bind that organization. Unless we have a separate written agreement with that organization, the Services remain subject to the personal-use restrictions described below.

You must be at least 16 years old to use PersonalTraits.

If you are under the age of majority in your country, state, or place of residence, you may use the Services only with the consent and supervision of a parent or legal guardian.

Purchases, paid reports, premium services, or paid features are available only to users who are at least 18 years old, or who have the valid authorization of a parent or legal guardian.

By using the Services, you represent and warrant that you meet these requirements, have the legal capacity to accept these Terms, and will provide accurate, current, and complete information.

We may refuse access, suspend an account, cancel a purchase, or delete an account if we reasonably believe that a user does not meet these requirements.

Some features may require you to create a PersonalTraits account.

When creating an account, you may be asked to provide information such as your name or username, email address, password, age range, gender selection, profile preferences, test answers, and other information necessary to provide the Services.

You agree to provide accurate information, keep your login credentials confidential, not share your account with unauthorized persons, promptly update your information if it changes, and notify us if you suspect unauthorized access to your account.

You are responsible for all activity under your account, except where such activity results from our failure to apply reasonable security measures.

We may suspend, restrict, or terminate your account if we reasonably believe that you violated these Terms, provided false or misleading information, compromised the security of the Services, engaged in fraud, attempted to copy or scrape the Services, or violated applicable law or the rights of others.

You may request deletion of your account by contacting support@personaltraits.co or through any account deletion feature made available on the Platform.

We may delete inactive accounts after 24 months without login or meaningful activity, subject to prior notice where required by law. Certain data may be retained after account deletion where necessary for legal, security, accounting, fraud prevention, dispute resolution, backup, or legitimate business purposes, as described in our Privacy Policy.

The TSI Test and Results are generated from the answers you provide and from the interpretive logic of the TSI model. Your Results represent a tension-based reading of your responses at a particular moment.

Your Results may vary depending on your current mood, emotional state, life context, age, experiences, level of self-awareness, interpretation of the questions, honesty and consistency of responses, and changes in your environment, relationships, work, or personal circumstances.

The Results are not a fixed identity, permanent label, scientific certainty, or complete description of your personality.

PersonalTraits does not guarantee that your Results will be perfectly accurate, complete, exhaustive, or applicable to every aspect of your life.

You should read your Results as a tool for reflection, not as a final truth about who you are.

PersonalTraits is not a medical, psychological, psychiatric, therapeutic, clinical, or health-care service.

The Services do not provide medical advice, psychological diagnosis, psychiatric diagnosis, therapy, clinical assessment, mental health treatment, emergency support, professional counseling, medical prescriptions, or evaluation of disability, illness, disorder, or mental health condition.

The TSI Test and Results must not be interpreted as a diagnosis, treatment recommendation, medical opinion, psychological evaluation, psychiatric assessment, or substitute for consultation with a qualified professional.

Even if the Services refer to concepts such as energy, security, identity, belonging, coherence, stress, internal tension, motivation, emotional patterns, or mortality, these concepts are used within the proprietary TSI model and are not medical or clinical categories.

If you are experiencing psychological distress, mental health difficulties, suicidal thoughts, self-harm thoughts, a medical emergency, or any urgent situation, you should immediately contact a qualified professional, emergency services, or a crisis hotline available in your country.

Use of PersonalTraits does not create a doctor-patient, therapist-client, psychologist-client, counselor-client, fiduciary, or other professional health relationship between you and VPS Media Intl LLC.

PersonalTraits is intended for personal, private, educational, self-reflective, and personal development use.

Unless we have entered into a separate written agreement with you or your organization, you may not use the Services, TSI Test, Results, Reports, or any PersonalTraits content for recruitment, hiring, promotion decisions, employee screening, school admission, academic selection, medical assessment, psychological assessment, insurance decisions, credit decisions, legal decisions, governmental decisions, disciplinary decisions, discrimination, exclusion, or ranking, scoring, or profiling another person without lawful basis and consent.

You must not use the Services to make important decisions about another person’s rights, opportunities, employment, education, health, legal status, financial access, or social standing.

Any professional, educational, institutional, human resources, coaching, consulting, or organizational use requires our prior written authorization and may be subject to separate terms.

PersonalTraits may allow you to share your Results with friends, family members, close contacts, or social networks. You are solely responsible for deciding what you share and with whom you share it.

You agree not to publish another person’s Results without their consent, use another person’s Results to mock, harass, shame, manipulate, pressure, exclude, or discriminate against them, present Results as a medical, psychological, professional, or scientific diagnosis, share Results in a misleading or harmful context, or use shared Results to make important decisions about another person.

If you share your own Results outside the Platform, you understand that we are not responsible for how third parties react to, interpret, copy, store, or use Results that you voluntarily share.

PersonalTraits may offer features that allow users to compare their TSI profile with another user, such as a friend, partner, colleague, family member, or close contact.

These features are intended for personal reflection, relationship understanding, and personal development only. They must not be used to diagnose, manipulate, pressure, rank, shame, exclude, discriminate against, or make important decisions about another person.

You may only use a relationship or profile comparison feature with the informed and voluntary participation of the other person involved.

Before a comparison report is generated, each invited participant should be clearly informed that their TSI profile data may be used to create a shared compatibility or relationship report, including a compatibility score, natural affinities, potential friction points, and relationship suggestions.

A simple visit to an invitation link does not constitute consent to participate. The invited participant must take a clear affirmative action, such as clicking “I agree to participate in this comparison” or an equivalent consent mechanism, before a comparison report is generated.

You must not submit, recreate, infer, or analyze another person’s profile without their permission.

Unless the relevant user has expressly authorized it, detailed TSI scores are not displayed to the other participant. Raw test answers and sub-tension scores are not displayed to the other participant, unless a feature clearly states otherwise and specific consent is provided.

A user may withdraw from a comparison feature or revoke the display of certain information where such controls are available. If one participant withdraws, the comparison report may become unavailable, deleted, or de-identified, subject to legal, security, accounting, dispute-resolution, or legitimate business retention needs.

Relationship and comparison reports are not therapy, couple counseling, psychological advice, mediation, diagnosis, or a guarantee of compatibility.

PersonalTraits may initially provide certain Services free of charge.

We may also offer paid features, including premium personality reports, extended analysis, personalized AI-assisted reports, downloadable reports, relationship or comparison tools, additional test modules, or future premium services.

At launch or during certain periods, the Services may be free. If paid features are introduced, the price, currency, taxes, scope of access, and material conditions will be displayed before purchase.

One-time premium reports may be offered at the price displayed at checkout before purchase. The applicable price, currency, taxes, and material purchase conditions will be shown clearly before payment.

We may change, add, remove, or modify free or paid features at any time. Such changes will not affect a paid purchase already completed, except where necessary for security, legal, technical, or operational reasons.

If you purchase a paid feature, you agree to pay all applicable fees displayed at checkout, including any applicable taxes.

Payments may be processed by Third-Party Services such as Stripe, PayPal, or other payment processors. We do not directly store full payment card details unless expressly stated. Payment information is handled by the relevant payment provider according to its own terms and privacy policy.

You represent and warrant that you are authorized to use the payment method you provide, that your billing information is accurate and complete, and that you will not make fraudulent purchases, attempt to avoid payment, or misuse refund procedures.

We may refuse, cancel, or reverse a purchase if we reasonably believe that the transaction is fraudulent, unauthorized, unlawful, abusive, or made in violation of these Terms.

PersonalTraits currently intends to offer a free experience and may offer one-time premium purchases. If we introduce subscriptions or automatically renewing services in the future, the subscription terms will be clearly displayed before you subscribe.

If you purchase a subscription in the future, you will be informed before purchase of the price, billing frequency, renewal date, duration, whether it renews automatically, how to cancel, and whether a free or discounted trial converts into a paid subscription.

If a subscription renews automatically, you authorize us or our payment provider to charge your payment method at the applicable recurring interval until you cancel.

Cancellation must be made through the account settings, payment provider interface, cancellation link, or by contacting support@personaltraits.co, depending on the options made available at that time.

If you cancel a subscription, cancellation will generally take effect at the end of the current paid billing period unless otherwise required by law or stated at purchase.

We will endeavor to make cancellation reasonably accessible and not more difficult than subscription, subject to technical and legal requirements.

Certain PersonalTraits products, including Premium Reports, personalized analyses, downloadable reports, AI-assisted reports, and relationship comparison reports, are digital content or digital services delivered online and may be generated, accessed, downloaded, or consumed immediately after purchase.

All purchases of Premium Reports and personalized digital analyses are final once the report has been generated, accessed, downloaded, delivered, or made available to your account, except where a refund is required by applicable law or where one of the limited exceptions below applies.

Where applicable law grants you a right of withdrawal, cancellation, refund, or other mandatory consumer protection right, you may exercise that right in accordance with such law. However, where permitted by applicable law, you may be asked at checkout to expressly request immediate access to your digital report and to acknowledge that, once the report is generated, accessed, downloaded, delivered, or made available, you will lose your right of withdrawal.

At checkout, we may require a separate confirmation such as: “I request immediate access to my digital report and acknowledge that, once the report is generated or made available, I may lose my right of withdrawal where permitted by applicable law.”

Refunds are not provided simply because you changed your mind, disliked your Results, disagree with the interpretation, no longer want the report after accessing it, or forgot that digital content may become non-refundable once generated or made available.

We will consider a refund only in limited cases, such as:

• duplicate payment for the same report;
• proven technical failure preventing access to the purchased report;
• billing error caused by us or our payment provider;
• unauthorized transaction, subject to verification;
• failure by PersonalTraits to generate or deliver the purchased report after payment.

We may refuse a refund request where we reasonably believe that:

• the report has been generated, accessed, downloaded, copied, shared, exported, or substantially consumed;
• the request is based on dissatisfaction with the interpretation rather than a technical or billing issue;
• the request is abusive, repeated, automated, coordinated, or fraudulent;
• the user violated these Terms;
• the user attempted a chargeback while also requesting a refund;
• the purchase was made using false or misleading information;
• the refund request is made after any applicable refund period;
• the refund is not required by applicable law and does not meet the limited exceptions described above.

If you receive a refund for a paid digital report or analysis, you agree to stop using the refunded paid content and delete any downloaded or saved copies where reasonably possible. We may also revoke access to the refunded report or related premium features.

Nothing in this Refund Policy limits any mandatory consumer rights that may apply to you under the laws of your country, state, or place of residence.

PersonalTraits may use artificial intelligence technologies to generate, personalize, enrich, translate, summarize, or analyze Results, reports, recommendations, explanations, relationship comparison reports, or other content.

AI Features may rely on third-party AI providers, including but not limited to OpenAI, Google, DeepSeek, or other AI technology providers.

AI-generated or AI-assisted outputs may be inaccurate, incomplete, outdated, biased, inappropriate, or not fully adapted to your personal context. You should review all AI-assisted content with discernment.

AI Features do not provide medical, psychological, psychiatric, therapeutic, legal, financial, professional, employment, or business advice.

You remain solely responsible for any decision you make based on AI-assisted content.

You agree not to submit sensitive, confidential, medical, financial, legal, or third-party personal information into any free-text field, AI chat, feedback box, or other input area unless the Platform clearly states that such information is required and explains how it will be processed.

We may process anonymized, aggregated, pseudonymized, or de-identified AI interaction data to improve the Services, subject to our Privacy Policy and applicable law.

Your use of PersonalTraits involves the collection and processing of personal data.

Depending on your use of the Services, we may collect and process information such as email address, login credentials or authentication information, age or age range, gender selection, answers to the TSI Test, scores across the eight TSI tensions, sub-tension scores, generated Results and reports, relationship comparison reports, account preferences, payment-related information, IP address, device information, browser information, usage logs, cookies and similar technologies, feedback, testimonials, comments, and support communications.

If you are logged into your account, your Results and reports may be saved in your personal space.

If you are not logged into an account, certain Results or interaction data may be retained in anonymous, aggregated, pseudonymized, or de-identified form for service improvement, security, research, analytics, or product development, subject to our Privacy Policy and applicable law.

Personal data retention periods are described in our Privacy Policy. As a general indication, account data is usually retained while your account remains active, and certain data may be retained after deletion where necessary for legal, accounting, security, fraud-prevention, dispute-resolution, backup, or legitimate business purposes.

For users located in the European Economic Area, the United Kingdom, Switzerland, or another jurisdiction with similar data protection laws, our processing of personal data may be based on one or more legal bases, including:

• Performance of a contract: to create and manage your account, provide the TSI Test, generate Results, deliver reports, process purchases, and provide customer support;
• Consent: where required for optional cookies, marketing communications, certain analytics, optional AI features, relationship comparison features where required, affiliate tracking where required, surveys where required, or other processing that legally requires consent;
• Legitimate interests: to maintain security, prevent fraud, improve the Services, understand product usage, protect our intellectual property, develop PersonalTraits, and operate the Services, provided that such interests are not overridden by your rights and freedoms;
• Legal obligations: to comply with accounting, tax, consumer protection, dispute resolution, regulatory, or other legal requirements;
• Your explicit consent or another applicable legal basis: where we process data that may be considered sensitive or subject to special protection under applicable law.

PersonalTraits is not designed to collect medical, psychiatric, therapeutic, clinical, or health data. You should not submit such information unless we expressly request it and explain why it is needed.

Depending on your location and applicable law, you may have rights regarding your personal data, including the right to request access, correction, deletion, restriction, objection, data portability, withdrawal of consent where processing is based on consent, and the right to lodge a complaint with a competent data protection authority.

These rights may be subject to conditions, exceptions, or limitations under applicable law.

PersonalTraits may use cookies, local storage, pixels, SDKs, analytics identifiers, affiliate attribution technologies, and similar technologies to operate the Platform, remember preferences, secure accounts, measure performance, improve the Services, attribute purchases to partners or creators, and, where applicable, support marketing or analytics.

Where required by law, we will request your consent before using non-essential cookies or similar tracking technologies.

You can manage cookies through your browser settings and, where available, through our cookie preference tools.

The Services, Platform, PersonalTraits brand, TSI model, Tension Score Index, test structure, tension dimensions, sub-tensions, questionnaires, scoring methods, report structures, generic report texts, prompts, algorithms, databases, software, interfaces, layouts, graphics, icons, logos, mascots, characters, illustrations, charts, videos, audio, documents, educational content, and all related materials are owned by VPS Media Intl LLC or used under license by VPS Media Intl LLC.

All rights not expressly granted to you are reserved.

Nothing in these Terms transfers to you any ownership right in PersonalTraits, the TSI model, the Platform, the Services, or any underlying intellectual property.

You may not, without our prior written permission, copy the TSI Test, reproduce questions or answer structures, extract or scrape the Platform, replicate the scoring model, publish or resell reports, reverse engineer the Services, create a competing product based on PersonalTraits content, use our trademarks or branding, remove copyright or proprietary notices, translate or adapt our content for commercial use, or use our proprietary content in a way not expressly permitted by these Terms.

Unauthorized use of our intellectual property may result in account termination, removal of access, legal action, and claims for damages.

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial purposes.

This license allows you to take the TSI Test, view your own Results, access your account, download your own report where download is enabled, share your own Results using features provided by the Platform, and use PersonalTraits for personal reflection and self-discovery.

This license does not allow you to exploit the Services commercially, use the Services for unauthorized professional purposes, copy the underlying model, redistribute paid content, create derivative personality tests based on TSI, use PersonalTraits content to build or train competing systems, or share paid reports publicly in a way that enables others to avoid payment.

You may use your own PersonalTraits Results for personal, private, and non-commercial purposes. However, your access to your Results does not give you ownership of the TSI model, scoring system, report templates, generic interpretation texts, prompts, algorithms, visual designs, platform logic, proprietary explanations, underlying databases, or PersonalTraits intellectual property.

We may revoke this license if you violate these Terms.

You are expressly prohibited from using any PersonalTraits content, data, structure, report, output, question, answer format, scoring logic, prompt, interpretation, visual element, database, or methodology to train, fine-tune, evaluate, benchmark, improve, develop, or operate any artificial intelligence, machine learning, deep learning, large language model, automated decision system, or similar technology.

This prohibition applies whether the use is commercial, non-commercial, academic, experimental, internal, or research-based, unless we have provided prior written authorization.

You may not use the Services to:

• train or fine-tune a model;
• evaluate or benchmark an AI system;
• extract or infer the TSI methodology;
• create a competing personality assessment tool;
• reproduce the TSI scoring system;
• generate synthetic datasets based on PersonalTraits outputs;
• scrape or collect reports, questions, answers, or outputs for AI or automated analysis;
• build any product or service that substitutes for or competes with PersonalTraits.

Violation of this section may result in immediate termination of your account and may subject you to legal action and damages.

PersonalTraits may allow you to submit User Content, including feedback, private comments to the editor, satisfaction comments, suggestions, testimonials, profile comparisons, social sharing posts, survey answers, or other content.

You are solely responsible for your User Content and represent that you own or have the necessary rights to submit it, that it does not violate the rights of any third party, and that it is not unlawful, defamatory, misleading, abusive, hateful, discriminatory, obscene, threatening, harassing, or otherwise harmful.

By submitting User Content, you grant VPS Media Intl LLC a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, process, transmit, adapt, and use that User Content as necessary to operate, secure, improve, promote, and provide the Services.

For private feedback submitted to the editor or support team, we will treat it as non-public unless you authorize publication or unless disclosure is required by law, security, or legitimate operational needs.

For testimonials, we may display them publicly only where you have submitted them for that purpose or otherwise authorized their publication. For public testimonials using your name, image, likeness, or identifiable profile, we will obtain consent where required by law.

We may moderate, remove, hide, restrict, or refuse User Content if we believe it violates these Terms, applicable law, or the rights or safety of others.

We welcome general feedback about PersonalTraits.

We may invite you to participate in optional surveys, satisfaction questionnaires, or follow-up questions designed to improve the accuracy, relevance, and usefulness of PersonalTraits recommendations, reports, and future features. Participation in these surveys is voluntary and may be subject to our Privacy Policy.

If you submit suggestions, ideas, concepts, feature requests, product names, marketing ideas, theoretical improvements, designs, or other unsolicited materials, you retain any rights you may have in your submission, but you grant VPS Media Intl LLC a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, develop, commercialize, or otherwise exploit such submission without restriction, compensation, confidentiality obligation, or attribution.

Your submission is voluntary and does not create any ownership claim, partnership, employment relationship, fiduciary duty, or obligation between you and us.

This section does not affect your rights in personal data as described in our Privacy Policy.

You agree not to use the Services to violate any law, infringe intellectual property rights, copy or scrape the Services, reverse engineer source code or scoring logic, bypass paywalls or security systems, use bots or data mining tools without permission, create multiple accounts to abuse features, share accounts to avoid payment, upload malware, interfere with the operation of the Services, scan or test the security of the Platform without authorization, impersonate another person, submit false or fraudulent information, harass or abuse others, publish or misuse another person’s Results without consent, use the Services for unauthorized recruitment or diagnosis, misuse relationship comparison features, generate harmful or discriminatory conclusions about protected groups, commercially exploit PersonalTraits content, or develop a competing product based on our content, model, reports, scoring, or proprietary structure.

Violation of this section may result in suspension, termination, content removal, refusal of refunds, and legal action.

PersonalTraits may rely on Third-Party Services, including hosting providers, database providers, payment processors, email providers, analytics services, AI providers, affiliate tracking providers, social networks, cloud infrastructure providers, and other technical or business partners.

Third-Party Services may include, without limitation, providers such as OpenAI, Google, DeepSeek, Stripe, PayPal, Vercel, Supabase, or other providers used from time to time.

Your use of Third-Party Services may be subject to their own terms, privacy policies, and practices.

We are not responsible for third-party websites, services, content, policies, acts, omissions, outages, security incidents, or errors, except where liability cannot be excluded under applicable law.

We aim to provide a useful and reliable service, but we do not guarantee that PersonalTraits will always be available, uninterrupted, secure, error-free, or compatible with every device, browser, country, or language.

We may modify, suspend, replace, limit, or discontinue all or part of the Services at any time, including for maintenance, security, legal compliance, technical changes, product improvements, business reasons, third-party service interruptions, prevention of abuse, or prevention of fraud.

We are not liable for temporary or permanent unavailability of the Services, except where applicable law provides otherwise.

To the fullest extent permitted by applicable law, the Services are provided “as is” and “as available.”

We make no warranty that the Services will meet your expectations, that Results will be perfectly accurate, complete, or exhaustive, that AI outputs will be reliable or error-free, that relationship comparison reports will accurately predict or guarantee the quality of a relationship, that the Platform will be uninterrupted or secure, that defects will be corrected immediately, that the Services will be free from harmful components, that the Services will be available in every country or language, that translations will be perfectly accurate, or that the Services are suitable for any specific professional, medical, psychological, educational, or commercial purpose.

Nothing in the Services should be interpreted as professional advice.

To the fullest extent permitted by applicable law, VPS Media Intl LLC, its owners, officers, employees, contractors, affiliates, licensors, service providers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or similar damages arising from or related to your use of the Services.

This includes, without limitation, loss of profits, loss of revenue, loss of data, loss of goodwill, loss of opportunities, emotional distress, reputational harm, business interruption, decisions made based on Results, relationship decisions, employment decisions, educational decisions, financial decisions, reliance on AI-generated content, unauthorized use of shared Results, misuse of relationship comparison features, or third-party service failures.

You are solely responsible for any decisions you make based on your Results, reports, relationship comparison reports, AI outputs, or any content provided through the Services.

To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services will not exceed the greater of: (1) the amount you paid to PersonalTraits for the specific Service giving rise to the claim during the twelve (12) months before the claim; or (2) USD 100.

Some jurisdictions do not allow certain limitations of liability. In such cases, the limitations above apply only to the maximum extent permitted by applicable law. Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

You agree to defend, indemnify, and hold harmless VPS Media Intl LLC, its owners, officers, employees, contractors, affiliates, licensors, service providers, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising from or related to your use or misuse of the Services, violation of these Terms, violation of applicable law, User Content, infringement of intellectual property or privacy rights, unauthorized use of another person’s Results, misuse of relationship comparison features, prohibited professional or discriminatory use, or any activity under your account.

We reserve the right to assume exclusive defense and control of any matter subject to indemnification, in which case you agree to cooperate with us.

If you believe that content available on PersonalTraits infringes your copyright or other intellectual property rights, contact us at legal@personaltraits.co and include your name and contact information, a description of the work you claim has been infringed, the URL or location of the allegedly infringing content, a statement that you have a good-faith belief that the use is not authorized by the rights owner, its agent, or the law, a statement that the information in your notice is accurate and that you are the rights owner or authorized to act on behalf of the rights owner, and your physical or electronic signature.

We may remove or disable access to content alleged to infringe intellectual property rights and may terminate accounts of repeat infringers where appropriate.

You may stop using the Services at any time and may request deletion of your account by contacting support@personaltraits.co or by using any account deletion tool made available through the Platform.

We may suspend, restrict, or terminate your access to the Services at any time if we reasonably believe that you violated these Terms, your conduct may harm us, other users, or third parties, your account is used fraudulently, your use creates legal, security, or operational risk, you infringe our intellectual property, you misuse AI Features, you misuse relationship comparison features, or you violate applicable law.

Upon termination, your right to access the Services ends; your access to certain Results or reports may end; we may delete or retain data as described in our Privacy Policy; and provisions that by their nature should survive termination will continue to apply, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and payment obligations.

We may modify these Terms from time to time to reflect changes in the Services, law, technology, business practices, security requirements, or operational needs. When we update these Terms, we will update the “Last updated” date above. Where required by law or where changes are material, we may notify you by email, in-app notice, website banner, or other reasonable means.

Your continued use of the Services after updated Terms become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and may request deletion of your account.

PersonalTraits may be made available in multiple languages, including English, French, Spanish, Italian, German, Chinese, Japanese, Korean, and others. The official legal version of these Terms is the English version, unless applicable law requires otherwise. Translations are provided for convenience. If there is any conflict between the English version and a translated version, the English version will govern to the fullest extent permitted by applicable law.

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. We may assign, transfer, or delegate our rights and obligations under these Terms in connection with a merger, acquisition, restructuring, sale of assets, corporate transaction, change of control, or operation of law, provided that such transfer does not materially reduce your mandatory consumer rights.

These Terms are governed by the laws of the State of New Mexico, United States, without regard to conflict of law principles. However, if you are a consumer residing outside the United States, nothing in these Terms limits any mandatory consumer protection rights that cannot be waived under the laws of your country or place of residence.

Before initiating arbitration or legal proceedings, you agree to first contact us at legal@personaltraits.co and attempt to resolve the dispute informally. Your notice should include your name, account email, a description of the dispute, the remedy you are seeking, and any relevant supporting information. We will attempt to resolve the dispute in good faith. If the dispute is not resolved within 60 days after receipt of the notice, either party may proceed as described below.

To the fullest extent permitted by applicable law, you and VPS Media Intl LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Services, your account, your Results, your purchase, or your relationship with PersonalTraits will be resolved by binding individual arbitration rather than in court.

The arbitration will be conducted in English and administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, unless another arbitration provider or process is mutually agreed by the parties. The seat and venue of arbitration will be Bernalillo County, New Mexico, United States, unless remote, online, written, or local arbitration is required by applicable consumer law or agreed by the parties.

You and VPS Media Intl LLC agree that arbitration will be conducted only on an individual basis. You may not bring any claim as a plaintiff or class member in a class action, collective action, consolidated action, private attorney general action, or representative proceeding. The arbitrator may award relief only in favor of the individual party seeking relief and only to the extent necessary to resolve that party’s individual claim.

This arbitration clause does not prevent either party from seeking temporary or preliminary injunctive relief in a court of competent jurisdiction to protect intellectual property, confidential information, security, or unauthorized use of the Services. This arbitration clause does not apply where prohibited by applicable law and does not limit mandatory consumer rights that cannot be waived.

For any claim that is not subject to arbitration and is not required by applicable law to be brought elsewhere, you and VPS Media Intl LLC agree to the exclusive jurisdiction of the state or federal courts located in New Mexico, United States. Where mandatory consumer protection law gives you the right to bring claims in your local courts, this section does not limit that right.

We will not be liable for any delay, failure, interruption, or inability to perform resulting from events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, power outages, internet failures, cloud provider outages, cyberattacks, governmental actions, pandemics, regulatory changes, or failures of third-party providers.

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or of any other rights.

These Terms, together with our Privacy Policy, Cookie Policy, Refund Policy, and any additional terms displayed at purchase or for specific features, constitute the entire agreement between you and VPS Media Intl LLC regarding the Services.

Nothing in these Terms creates any partnership, joint venture, employment, agency, franchise, fiduciary, medical, therapeutic, or professional advisory relationship between you and VPS Media Intl LLC.
